1. About these terms

These Terms and Conditions govern your use of the AIM platform at ai-moments.africa, including all Workflows, PlayBooks, and any other content or services available on or through the platform. By accessing or using the platform, you agree to these terms.

The platform is operated by AIMING GLOBAL PTY LTD, a company registered in South Africa. References to "AIM", "we", "us", or "our" in these terms refer to AIMING GLOBAL PTY LTD.

If you do not agree to these terms, please do not use the platform.

2. Who can use the platform

You may use the platform if you are at least 18 years old and capable of entering into a legally binding agreement. By using the platform, you confirm that this is the case.

If you are using the platform on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these terms.

3. What the platform offers

AIM provides a library of AI Workflow guides, PlayBook bundles, and related content designed to help individuals and organisations implement AI in their operations. Content is available in free and premium tiers.

We also offer an AI Opportunity Assessment service, which is a paid consulting session described on the Services page of the platform.

We reserve the right to change, update, or discontinue any part of the platform or its content at any time without notice.

4. Purchases and payments

Certain content and services on the platform are available for purchase. All prices are displayed in South African Rand (ZAR) and are inclusive of any applicable taxes unless stated otherwise.

Payments are processed securely through Paystack. We do not store your payment card details. By completing a purchase, you authorise the charge to your chosen payment method.

All sales are final. We do not offer refunds except where required by applicable South African consumer protection law. If you believe you have been incorrectly charged, please contact us at support@ai-moments.africa within 7 days of the transaction.

5. Intellectual property

All content on the platform — including Workflow guides, PlayBooks, prompt templates, written content, design elements, and the AIM brand — is the intellectual property of AIMING GLOBAL PTY LTD or its licensors and is protected by applicable copyright and intellectual property laws.

When you purchase access to content on the platform, you are granted a personal, non-transferable licence to use that content for your own internal business purposes. This licence does not permit you to:

  • Reproduce, redistribute, resell, or sublicense any platform content
  • Share purchased content with third parties outside your organisation
  • Remove or obscure any copyright, trademark, or attribution notices
  • Use AIM content to build competing products or services

Content you submit to the platform — such as CV uploads or assessment intake form responses — remains your property. By submitting it, you grant us a limited licence to use it for the purpose for which it was submitted.

6. Your data and privacy

We collect and process personal information in accordance with applicable South African data protection law, including the Protection of Personal Information Act (POPIA).

The types of personal information we may collect include:

  • Email addresses collected via our email capture form or at purchase
  • CV and professional profile information submitted via our talent intake form
  • Contact and business information submitted via the AI Opportunity Assessment intake form
  • Transaction records associated with purchases

We use this information to deliver the services you have requested, to send you updates about new workflows and platform content (where you have opted in), and to improve the platform.

We do not sell your personal information to third parties. We may share it with trusted service providers strictly for the purpose of delivering our services.

You have the right to request access to, correction of, or deletion of your personal information. To exercise these rights, contact us at support@ai-moments.africa.

7. No warranty on workflow outcomes

The Workflows, PlayBooks, and other content on the platform are provided as practical implementation guides. We make no warranty, express or implied, that any workflow or content will produce a specific result in your particular business context. Outcomes will vary depending on your tools, team, processes, and how the workflow is implemented.

The platform and its content are provided "as is" and "as available". We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the maximum extent permitted by applicable law, AIMING GLOBAL PTY LTD will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the platform or its content.

Our total liability to you for any claim arising from your use of the platform will not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable South African law.

9. Third-party tools and integrations

The workflows and content on the platform frequently reference or recommend third-party tools and platforms such as ChatGPT, Claude, HubSpot, and Zapier. These are independent products not affiliated with AIM. We are not responsible for the availability, accuracy, or terms of any third-party tool.

10. Acceptable use

You agree not to use the platform in any way that:

  • Violates any applicable law or regulation
  • Infringes the rights of any third party
  • Involves scraping or automated extraction of platform content
  • Attempts to circumvent any payment or content access controls
  • Introduces malicious code or attempts to compromise platform security

We reserve the right to suspend or terminate your access to the platform if we reasonably believe you have breached these terms.

11. Changes to these terms

We may update these terms from time to time. When we do, we will update the effective date at the top of this document. Your continued use of the platform after changes are published constitutes your acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from or relating to these terms or your use of the platform will be subject to the jurisdiction of the South African courts.
